This paper presents a framework for analyzing the WTO's Appellate Body and its ability to settle international disputes. The authors present their framework in the context of US and EU courts then apply it to predict the behavior of judges in the Appellate Body. The authors foresee that the Appellate Body's rulings, especially its early years, will shape the extent to which it gains legitimacy as the pre-eminent arbitrator of international trade disputes.
