This brief discusses the fundamental gap in Afghanistan's legal and political system concerning the lack of agreement over which entity has the power to resolve constitutional disputes. The author begins by examining the 2003 constitutional drafting process and the role of the Afghan Supreme Court. He traces the development of the dispute through the Supreme Court and the executive branch's attempts to resolve jurisdictional questions, then concludes by providing possible solutions to the problem.
