This paper examines Spain’s investment arbitration practices, focusing specifically on the country’s controversial incentive regime and its impact on renewable energy schemes. As the text’s author sees it, the drastic reduction and subsequent elimination of public incentives for renewable energy production has antagonized both foreign and national investors, many of whom are pursuing legal claims in domestic and International courts. Resolving these claims remains “of paramount importance,” argues the author, because of their potentially far-reaching legal and economic consequences.
