The article presents the major developments relating to Section 49 of the Criminal Procedure Act, the law related to the use of lethal force for arrest in South Africa, since 1994. It explores the relationship between the questions of principle raised by the Constitutional Court in death penalty judgment, the use of lethal force and the legal framework which exists in South Africa in relation to the leading judgments of the Supreme Court of Appeal and the Constitutional Court.
