This paper explores questions surrounding the role of truth commission and justice, given that it is not a judicial body as such, and assignment of guilt and punishment is not its primary concern. The author examine this conflict in the context of South African and its Truth and Reconciliation Commission (TRC). She focuses on three different aspects in the TRC process: the period of legislative enactment, leading to the adoption of the Promotion of National Unity and Reconciliation Act; the Special Legal Hearing (SLH); and the attitude of the legal profession concerning the TRC.
