This paper focuses on the release of four previously classified memos on torture in April 2009 by the US Justice Department. It addresses questions regarding possible criminal liability for the officials who carried out aggressive interrogations or who formulated the legal guidance authorizing them. The author also analyzes some issues of state responsibility under international law.
