This article discusses the US Federal Court of Appeal's rejection of an appeal by a Guantanamo detainee, a Yemeni Ghaleb Nassar Al-Bihani on 5 January 2010. It shows that he challenged the legality of his extrajudicial detention and alleged a violation of the principles of international laws of war. The court found the detention lawful in the light of US law.
