This brief critically evaluates the draft EU constitution. The author argues that although some progress has been made, the complexity and opaqueness of the document mean that it will not engender a common European constitutional identity. The brief highlights a number of areas where the draft could be improved and outlines the difficulties likely to be encountered during the ratification process.
