This monograph discusses the South African National Prosecuting Authority (NPA), which is regarded by the authors as being pivotal not only to the criminal justice system, but also to the proper functioning of democracy in the country. The focus is on the independence, accountability and performance of the NPA in relation to its core prosecuting function. The author finds that the prosecution has a tendency to decline to prosecute in an increasing number of cases and argues that this failure to act is the central malaise affecting the NPA.
