This report provides a literature review on torture and cruel, inhuman and degrading treatment (CIDT) and argues that the term 'torture' should not be used restrictively, but expansively to also include CIDT. It also looks at the South African government’s support of international and continental instruments, charters and conventions/legislations against torture and CIDT. The author then addresses how non‐nationals are treated by the South African government, which has promulgated various legislations and acts, such as the Immigration Act, to protect the rights of non‐nationals as enshrined in the South African constitution.
