This paper discusses the legal aspects of European Security and Defence Policy (ESDP), with a particular focus on Article 296 of the Amsterdam Treaty. The author discusses a number of consequences of European Court decisions, and explores the legal boundaries of the European Commission's role in armaments policy. She concludes that it is up to EU member states to find a correct balance between their national security interests and the goal of establishing a single armaments market.
