This note discusses the legal framework under which UK armed forces should operate. After examining the legal frameworks which traditionally applied to the armed forces, the note looks at some of the European Court of Human Rights (ECHR) cases brought by civilians who have been mistreated by British troops deployed overseas. The author then looks at the UK Government's obligations to members of the armed forces, in terms of ECHR rights, combat immunity and duty of care whilst on deployment. Finally, she considers the prospects for change in the legal frameworks that apply to the military.
