This paper discusses the legislative package relating to border controls in the Schengen area, which was proposed by the European Commission in September 2013. The author argues that while the negotiations were brought about by a political crisis, they have led to a balanced result between EU member states and the European Commission. This is because, in relation to Schengen governance, member states have ensured that their rights have been respected in areas of public policy, the Commission has gained a greater role in all areas, and the European Parliament has become an actor in its own right.
