This paper assesses the dubious legality of Greece’s detention of undocumented migrants and asylum seekers. In particular, it focuses on the Greek Legal Council’s February 2014 decision to detain 'irregular' migrants indefinitely, or at least until they consent to return to their home countries. After performing a cost-benefit analysis on this decision, the paper's authors 1) conclude that it violates Greece’s obligations under national, European and international law, and 2) provide recommendations on how to adopt more effective and sustainable migration policies.
