This paper examines the Maltese citizenship-for-sale program and considers its relevance for configurations of citizenship in the EU, both today and in the future. It argues that the EU’s intervention in the Maltese citizenship-for-sale affair constitutes a legal precedent for assessing the lawfulness of passport-for-sale programs in EU member states. It further argues that by intervening in national citizenship matters, the EU may be paradoxically encouraging nationalistic justifications of restrictive integration policies by member states.
