This paper examines the challenges facing the EU regarding data retention following the April 2014 judgment in the Digital Rights Ireland case by the Court of Justice of the European Union (CJEU), which found the Data Retention Directive 2002/58 to be invalid. The authors also look at the responses EU institutions and others have made to this judgment and provide recommendations for EU policy makers on how to move forward on data collection and protection.
