This commentary discusses the key challenges facing the EU's new Justice and Home Affairs (JHA) Program. The authors recommend that within the new JHA policy framework, the Commission should confine itself to program implementation rather than policy-sketching. The Commission should also be given a much more proactive role in helping national administrations implement EU legislation rather than taking member states to court. Additionally, cooperation between national administrations and EU institutions should be improved.
