This commentary provides an overview of the legal issues and disagreements surrounding claims by countries and especially China, to islands and island groups in the China Seas. The author contends that, in spite of the competing claims, the rule of law in the contested seas needs to be constructed on a foundation that is objective, fair and equitable.
