This study looks at the collision between European law and third-country law enforcement agencies, particularly when it comes to accessing electronic data held by private companies. More specifically, the study's authors 1) focus on the practical problems the EU & US face in providing legal and evidence-gathering assistance to each other in criminal proceedings; 2) survey the main legal instruments used by the EU to assess the lawfulness and legitimacy of third-country requests for private data; and 3) provide policy recommendations on how Brussels should tackle the rule of law challenges that are inherent in EU-US data access relations.
