This paper 1) analyzes the conceptual and practical foundations of international investment law (IIL), and 2) formulates a new investor protection framework that better reconciles the relationship between power, politics, and democracy. Put another way, the new approach would make the ILL system more transparent, primarily by involving more investors and other parties in decision-making processes, and tying investment law and democratic principles more closely together.
