This paper looks at US Supreme Court decisions that have led critics to call on Congress to modify how US waterways are defined and regulated through the enforcement of the Clean Water Act. Although the potential effects that the proposed modifications to the Act would have on private land owners are difficult to quantify, there is a growing consensus that redefining the waterways would have a negative impact on the economy. The author believes that the potentially adverse effects could be avoided through the proper administration of the Clean Water Act by the Army Corps of Engineers and the Environmental Protection Agency.
