This paper addresses transitional justice, the preferred way of dealing with atrocities committed by past regimes in countries that are transitioning to democracy. The author demonstrates that moving away from guilt to a consequence orientation removes the artificial boundaries that exist between civil and criminal law. He concludes that this is possible by implementing and institutionalizing the idea of 'restorative justice.'
