This paper examines issues relating to legality of the use of lethal force in police arrests in South Africa. It argues that a proposed law suffers from numerous flaws and emphasizes that legislation ought to be formulated in a practical and realistic manner. The author offers a framework that addresses the main legal concerns and suggests that these could bring the South African legal framework in line with its constitutional norms and international human rights standards.
