This bulletin examines the ongoing legal battle surrounding the OPAL gas pipeline. The fundamental problem is that the EU Commission has granted Gazprom permission to increase the amount of natural gas it can transport through the system, which runs counter to CJEU guidelines – i.e., guidelines that seek to limit Europe’s energy vulnerability by limiting the pipeline’s use by Russia.
