This paper reviews the experiences of Central European states with investment arbitration. The text’s author specifically analyzes 1) the effects of EU enlargement on the region’s investor-state dispute settlement practices, and 2) the contested compatibility of Intra-EU Bilateral Investment Treaties (BITs) with EU law. While Central European member states appear to adhere to a uniform approach to ISA, the continued controversy surrounding BITs isn’t a mere technical issue. It’s one that goes to the very heart of European integration and the lack of an effective EU mechanism for the protection of human rights, including the right to property.
