This article looks at the challenges and opportunities of reforming customary justice systems within the development context. It first exposes some of the difficulties associated with mainstream ‘topdown’ approaches to reforming customary justice systems. It then discusses a new and sparsely analyzed approach for enhancing the empowerment and access to justice of customary justice users: the introduction of community-level alternatives to customary dispute resolution.
