This paper argues that development policy should recognize the importance of engaging with customary justice systems in the effort to empower disadvantaged groups. It recognizes that these traditional channels are the prominent space in which poor and disadvantaged groups seek and receive remedy for their grievances. The author argue that access to justice is the foundation of legal empowerment and conclude with recommendations for the way forward towards understanding and engaging with these systems to enhance legal empowerment of the poor and disadvantaged.
