This paper examines the implications of the legislative changes introduced in South Africa, which the authors contend propose the creation of a separate legal regime for people within the the former ethnic enclaves that existed prior to the end of apartheid. The authors contend that the effect of such legislation will be to consolidate the unilateral authority of chiefs in the ethnic enclaves in relation to land ownership and deny other rural South Africans the right to decide for themselves how to use the newly discovered mineral wealth of the land they have owned and occupied for centuries.
